The John I. Mackay License v1.0

1. Preamble: The Goal

This license lets You share and use My work more freely than standard copyright allows, but requires You to display a clear link to the Attribution URL as specified in Clauses 2 & 5. It's my attempt to combine the spirit of open sharing with meaningful connection.

2. Key Definitions

• 'I,' 'Me,' 'My,' or 'Licensor' means John I. Mackay, the creator and copyright holder.
• 'The Work' means any original creative work I publish and explicitly associate with this license.
• 'You' or 'User' or 'Yours' means anyone who receives the Work.
• 'Share' or 'Sharing' means to copy, reproduce, distribute, or publicly display the Work.
• 'Adapt' or 'Adapting' means to modify, transform, or build upon the Work.
• 'Adjacent' means placed in context to the Work (e.g., as an image caption, in the video description, as a footnote on the same page or screen).
• 'Attribution URL' means: https://www.johnmackay.net

3. Relationship to Copyright Law

Nothing in this license shall be construed as restricting, limiting, or affecting any of Your rights that arise from the applicable copyright law's statutory exceptions and limitations, including but not limited to fair use, fair dealing, or quotation for criticism, review, or news reporting. Those rights are yours independently of this license.

Notably, this license does not restrict the act of hyperlinking to The Work where it is lawfully made available by the Licensor. The obligations of this license apply only when You exercise the licensed rights of Sharing or Adapting The Work itself.

4. The Permission I Grant You

4.1 Core Grant of Rights

Subject to the strict terms in Section 5 below, I grant You a worldwide, non-exclusive, royalty-free license to:

• Share the Work for any purpose, including commercially.
• Adapt the Work for any purpose, including commercially.

This license is perpetual and irrevocable for the Work as published.

4.2 Permission for Machine Learning & AI.

The rights granted in this license expressly include the use of the Work for the purpose of training, developing, fine-tuning, operating, or otherwise inputting into machine learning, artificial intelligence, generative models, neural networks, or similar algorithmic systems (collectively, "AI Systems").

Attribution Note for AI Outputs:

The requirements of Section 5 (Your Strict Requirements) apply only to the subsequent Sharing or Adapting of a Work, or of an AI-generated output that constitutes a direct, recognizable adaptation of the Work. They are not required for the internal processes of an AI System, nor for outputs that are not intended to be substantially similar copies or adaptations meant for human consumption as separate works.

5. Your Strict Requirements (The 'Price' of This Permission)

5.1 Mandatory Attribution.

When You Share or Adapt the Work, You must provide the Attribution URL that meets all the following criteria. The Attribution URL must be placed Adjacent to the Work as described in 5.1.2.

5.1.1 Attribution Content.

The credit must include, at a minimum, the following notice:

Do not add rel="nofollow" — leave it out so the link is dofollow by default.

For Plain Text (Where links are not possible):

(Optional: You may include 'Adapted from John I. Mackay' at the beginning for clearer attribution.)

5.1.2 Placement & Prominence.

The Attribution URL must be:

• Visibly Adjacent: Placed in direct association with the Work (e.g., as a caption, in a video description, as a footnote on the same page/screen).
• Functionally Linked: Where the medium permits, the license reference must be a functional hyperlink.
• Equally Prominent: Presented in a manner at least as easy for a viewer to notice as the Work itself.

5.2 Technical & Medium Specifications

• For Digital Media (Web, Apps, Ebooks): A functional, clickable hyperlink is required where the platform or format permits it. If hyperlinks are not permitted (e.g., in some social media text fields), you must display the full Attribution URL as plain text.
• For Non-Digital Media (Print, Broadcast, Physical Displays): You must display the full Attribution URL as plain text in the credit section.

5.3 No False Endorsement

You may not imply or state that I, the Licensor, endorse, sponsor, or am affiliated with You or Your use of the Work.

6. Other Important Terms

• No Warranty: The Work is provided 'as is,' without any warranties of any kind. I am not liable for any claims or damages resulting from Your use of the Work.
• No Trademark Rights: This license does not grant any rights to use my name, likeness, or personal brand for endorsement or advertising.
• Termination: Your rights under this license automatically terminate if You fail to comply with any of its terms. To reinstate them, you must correct the violation in a timely manner.
• Interpretation: If any provision of this license is deemed unenforceable, the remaining provisions remain in full effect.
• Governing Law & Jurisdiction: This license shall be governed by the laws of Australia. Any disputes shall be resolved in the courts located in Townsville, Queensland, Australia.

How to Apply This License

When I publish a Work under this license, I will mark it with text similar to: License: JIML v1.0' at the bottom of the web page. ...and I will link that notice to the License URL.

You do not need to notify me when you use my Work. Compliance with the terms is your notification.

💡 Plain-English Summary for Users

• You can: Use my stuff, even in commercial projects and modified forms.
• You must: Give me credit with a working link to the Attribution URL, placed right next to where you use my work.
• On a blog: Put the Attribution URL in the caption.
• On social media: Tag me and put the Attribution URL in the post text if character limits permit.
• In a video: Put the Attribution URLs in the on-screen description.
• In a book: Print the Attribution URL (https://...) in your acknowledgements/credits section.
• Don't: Hide the Attribution URL, break the links, or make it look like I work with/endorse you.
• AI Training: The training process itself does not require attribution.
